TERMS OF THE CONTRACT

PERU TREK: Tour operator.

CLIENT(S): Direct passenger(s) or travel agency(s).

ACCEPTANCE AND KNOWLEDGE OF OUR TERMS AND CONDITIONS

Once you have chosen your program, please read these terms and conditions as your booking is subject to the terms listed below. A contract is entered into once PERU TREK receives your reservation form and deposit, and we accept and confirm the reservation. They apply to all reservations and activities made through our website, via email or in person. The use of any of these channels implies knowledge and acceptance of them.

MODIFICATION OF THE TERMS OF USE

Peru Trek reserves the right to make modifications or updates to our terms of use at any time. It’s the responsibility of the customers to review them.

RESERVATION CONFIRMATION

Once the client sends his reservation request, the confirmation to this will be subject to the payment support according to the request, detailing all the services included and not included. If no response from the client is received, the acceptance of our terms and conditions will be assumed. In this sense, Peru Trek is not responsible for any extraordinary situation.

OBLIGATIONS OF PASSENGERS ESTABLISHED ACCORDING TO POLICIES OF PERU TREK
  • Respond clearly and precisely to responses and requests, such as forms to be filled out by your assigned Experience Designer.
  • Follow the instructions of the team en route.
  • Compulsory attendance at the informative meetings, which are held prior to your tour, are essential to begin the experience en route.
  • Comply with all the obligations set forth in these Terms and Conditions.

REQUIRED DEPOSITS FOR TOURS

PAYMENT / DEPOSIT

The deposit amount depends on the specific itinerary chosen by the client. The details are as follows:

Inca Trail:
  • Deposit: For Inca Trail packages, we need a deposit of 50% per person.
  • Note: Remember that these reservations are not transferable to other travelers. 
Alternative packages of more than 2 days:
  • Deposit: For alternative hikes, we require a 50% deposit per person.

1 Day Tours and Hikes:
  • Deposit: For 1-day tours and hikes, we require a 100% deposit per person.

City Tour in Cusco:
  • Deposit: For city tours, we need a deposit of 100% per person.

NOTA: These deposits are required to secure reservations: this may include Tickets, Permits, plane tickets, train tickets, cruises, hotels, restaurants and other services. Please note that these items may have different cancellation terms than those established by PERU TREK, as well as blackout dates with specific policies.

The expenses corresponding to our trip design and planning from the initial moment in which an inquiry is received and before the trip is made, including all communication, evaluation, modifications, reservations with experts, guides, third-party suppliers, among others.

PAYMENT POLICIES

Accepted Payment Methods:

  • For initial deposits and final payments, we accept Cash, Credit or Debit Cards, and PayPal.
  • No traveler can start the tour unless the payment has been fully settled.

Balance or Final Payment:

  • Balance payments must be made at least 2 days (48 hours) before your tour. Payments can be made in cash, Paypal, or Debit/Credit Card.
  • Paypal and card payments have a 8% service transaction fee.

Cash Payments:

  • Cash payments must be made at least 2 days before your tour.
  • We accept US dollars, Euros and Peruvian soles for cash payments.
  • Please note: Torn bills will not be accepted, regardless of the size of the damage.

Bank Commissions:

  • All associated bank commissions or transaction fees will be the client’s responsibility.

CANCELLATION AND REFUND POLICIES

Cancellation Request:

  • All cancellation requests must be formally emailed directly to your travel advisor.
  • The request must be made by the person who originally made the reservation and made the initial deposit.

Cancellation request for tours that do not include Machu Picchu and the Inca Trail:

  • All tours that do not include Entrance Tickets to Machu Picchu, Train Tickets, Inca Trail Tickets, Conssetur Bus Tickets, Museum and Archaeological Center Tickets, will be refunded 100% of the total deposit, instantly either in cash, Paypal or Bank Transfer.     Note: All returns and cancellations are made up to 5 days in advance.

Cancellation request for tours that include Machu Picchu and the Inca Trail:

  • Please note that tours include entrance tickets to Machu Picchu, train tickets, Inca Trail tickets, Conssetur bus tickets, tickets to museums and archaeological centers. A 100% refund will not be possible, as these tickets are purchased at the time of confirming your reservation to guarantee your trip 100%.

    In this case we will make the refund by subtracting the expenses incurred in purchases, reservations and contracted services, the company will reimburse 100% of the expenses not incurred, either by Paypal or by bank transfer, depending on the client’s availability. Change of Dates:

  • If you change the date, you must pay a penalty of USD $100.00 per person. Please note that this fee is not our responsibility; rather, we need to purchase new tickets as we have already secured all tickets for the original date and they will be lost.

    If you have requested additional tickets, such as Huayna Picchu, Huchuy Picchu or Machu Picchu Mountain, please note that an additional penalty will apply.

    It is important to note that tickets for Machu Picchu and others are non-refundable and non-transferable.

Additional Considerations:

  • If a client decides to end the trek after it has started, no refunds will be provided. The client will bear any extra expenses that result from this decision, including food, lodging, and transportation. However, they are welcome to rejoin the group for the Machu Picchu tour on the final day (where applicable).
  • If a client is unable to embark on the trek due to health or physical issues, no refunds will be provided. Similarly, the client will be responsible for subsequent costs like food, accommodation, and transportation. The client can rejoin the group for the Machu Picchu tour on the final day (where applicable).
  • In the event of natural disasters or unforeseen circumstances that prevent a service from being fulfilled, customers will receive a 50% refund, considering administrative expenses. Refunds will not be provided if such events cause alterations in the trek route.
  • In the event of global pandemics, refunds will not be issued if a service cannot be provided under these circumstances. Instead, clients will be offered an open ticket, allowing them to use the service on an alternative date, subject to availability.
  • Absence from informational meetings will be considered a no-show.
  • Failure to participate in a scheduled tour will also be considered a no-show. There will be no refunds for no-shows under any circumstances.
  • There are no refunds for omitted services included in your trek.

CANCELLATION REQUEST ONLY FOR INCA TRAIL

The cancellation request must be made via email by the person who made the reservation and paid the deposit to info@perutrek.org

When you book an Inca Trail tour, you get a specific permit exclusively in your name. It is essential to take into account the following points:

  • If the client cancels between 15 and 30 days before their trip, they must pay 50% of the total cost of the trip.
  • If the client cancels between 10 and 5 days before their trip, they must pay 80% of the total cost.
  • If the client cancels 3 days or less before their trip, they must pay 100% of the total cost.
  • In the rare event that a client decides to leave once the walk has begun, no refund will be given. The client must also pay any additional expenses incurred by their own decision such as food, accommodation and transportation. If desired, the client can join the group and participate in the tour to Machu Picchu on the last day if they wish.
  • If the client is unable to participate in the walk due to illness or physical problems, no refund will be made. The client must also pay for additional expenses incurred such as food, accommodation and transportation. If desired, the client can join the group and participate in the tour to Machu Picchu on the last day if they wish.
  • In the event that a natural disaster or a fortuitous event prevents the performance of a service, the client will receive a refund of 50% of the total cost of the package, considering administrative expenses.
  • In the event that a natural disaster or act of God causes a change to the hike route, there will be no refund.
  • In consideration of the last pandemic that was experienced worldwide, we include that, in the event that the service is not provided due to a pandemic or unforeseen event, no refund will be made, but an open ticket will be provided so that you can receive the service in another date subject to availability.
  • Failure to attend informational meetings will be considered an absence, There will be no refund option.
  • Failure to appear on the assigned route will be considered a no-show, There will be no refund option.

No date changes:

  • Permits for the Inca Trail are processed with the name and passport number; Under no circumstances may they be transferable to another person. It is also not possible to change the dates once the permit is acquired. These are non-refundable and non-transferable. Please note that PERU TREK (or any other travel agency) does not determine these conditions. They are standards applied by the Peruvian Government.

 

TOURS AND TREKS TERMS AND CONDITIONS

Pricing:

  • Prices are set per person based on shared accommodation for two (including hotels, campsites, and tents). Solo travelers may be paired with someone of the same gender. Personal tent or room requests may result in an additional charge.

Guidance and Group Dynamics:

  • By joining a Group Tour, you understand that the group’s pace and timings may differ due to individual capabilities. If you wish to explore different areas on your own or face issues during the tour or guide’s services, please address the guide immediately for resolution.

Transport and Itinerary:

  • All Adventure Treks ensure transportation back to Cusco, with the return train route (subject to availability). PERU TREK might adjust your itinerary if deemed necessary.

Required Information for Reservation:

  • we require the submission of specific personal details: full name, passport number, gender, nationality, and date of birth during the reservation process.

Health and Safety on the Trail:

  • If a participant becomes ill or injured and is unable to continue, a porter or staff member will escort them to a location where emergency assistance is available. The traveler will be responsible for any expenses incurred for helicopter airlifts and medical treatment. If illness prevents the completion of the tour, we will assist in rejoining the group at Machu Picchu (where applicable), but additional fees will apply. No refunds will be provided for the initial payment.

Responsibilities and Liabilities:

  • PERU TREK ensures the safety of our clients, hiring highly qualified professionals who take preventive measures to avoid accidents, illnesses, and personal property loss. We hold ourselves accountable for our employees’ actions but cannot be held responsible for the actions of third parties. Therefore, we advise our clients to oversee their personal and rented items for added safety.

    PERU TREK is not responsible for unfavorable weather, natural disasters, strikes, accidents, health issues, personal item loss, etc. Clients should have insurance covering these eventualities. We hold the right to change or cancel programs due to unforeseen adverse conditions.

Passport and Visas:

  • Travelers must ensure their passports are valid for a minimum of 6 months after their travel dates and have the necessary visas. PERU TREK is not responsible for any issues related to passports or visas.

    If you are renewing your passport, please contact us as soon as possible and send us a photo of both the old and new passport. Failure to update may result in denial of entry to Machu Picchu and other sites if you have booked beforehand.

Group Size and Tour Language:

  • Tours are primarily bilingual and conducted in English and Spanish. Tours have up to 12 participants from all ages and skills. Group size is subject to future changes.

Gratuities:

  • While tipping remains voluntary in Peru, guidelines are offered in your concluding travel documents during the briefing session the day before your tour.

Assumption of Risks:

  • Adventure and exploration have risks associated. These risks can be caused by natural forces, animals, insects and vegetation, among others. By continuing with your reservation, you acknowledge these potential risks. Your decision to join any of our tours indicates your voluntary acceptance and understanding of these risks.

Applicable Law:

  • All interactions, transactions, and potential disputes resulting from the use of this website or any engagement with PERU TREK will be subject to the Legal Jurisdiction of Peru. By using our services, you, the client, consent to the jurisdiction and governance of Peruvian courts for any issues or disputes that may arise.

 

MEDICAL INFORMATION AND RESPONSIBILITIES

Mandatory Disclosure:

  • When booking, travelers must inform PERU TREK of any existing medical conditions, allergies or specific health concerns.

Assessing Tour Suitability:

  • You are responsible for determining whether a tour is appropriate for you, considering your medical history, current condition, and physical abilities. Consult your doctor for medical guidance, vaccination recommendations, and other preventive measures. PERU TREK does not provide medical consultations or advice.

Health and Fitness:

  • Participants must be in optimal physical condition. If you have any questions about your health, consult your doctor. If you are over 70 years old, a current medical certificate proving your good health will be required.

Participation Rights:

  • PERU TREK retains the discretion to deny any individual the right to travel or participate in specific tour activities if their physical or mental condition is deemed unsuitable for the trip or poses a risk to themselves or others.

Pregnancy Disclosure:

  • Pregnancy is classified as a medical condition and must be disclosed at the time of booking. PERU TREK may decline to accept pregnant women or those with specific medical conditions if appropriate accommodations or alternatives can’t be ensured.

Travel Insurance:

  • We strongly advise all travelers to obtain comprehensive travel insurance. This can offer protection in medical emergencies, tour cancellations, or other unexpected events during the trip.

Your Health Is Our Priority:

  • PERU TREK places high importance on the safety and well-being of its clients. We urge all travelers to be transparent about their health status and to make informed decisions about their ability to embark on our tours.

RIGHT TO USE IMAGES

By participating in any of the activities offered by PERU TREK, the client expressly grants Peru Trek permission to capture and use any images, photographs and videos taken during the tour for promotional, advertising and any other marketing purposes. This includes, but is not limited to, use in brochures, online marketing and social media platforms.

The client acknowledges that he/she will not receive any financial or other compensation for the use of such images, photographs or videos. This consent is given freely and without expecting any return or benefit.

However, if the client does not want Peru Trek to use the images of their tour for promotional purposes, they must inform their Experience Designer via email before the trip.
